Critical Emergency Disclaimer
This service is not a medical, emergency, or safety monitoring service. It is a voluntary check-in reminder tool only. The service does not guarantee delivery of messages or alerts. In any emergency, contact local emergency services immediately — 999 in the UK or 112 in Europe. DailyNod and Samo accept no liability for missed check-ins, SMS delivery failures, or any outcomes resulting from use or non-use of this service.
Parties
These Terms constitute a legally binding agreement between Samo ("we", "us", "the Service") and the individual or entity subscribing to DailyNod ("you", "the Customer"). By completing payment and subscribing, you confirm you have read and accepted these Terms in full.
Subscription & Immediate Provisioning
The Service is priced at £9 per month, billed on a recurring basis via Stripe.
By subscribing, you explicitly request that performance of the digital service begins immediately upon payment confirmation. In accordance with the UK Consumer Rights Act 2015 (Schedule 3, Part 1), where a consumer expressly requests immediate performance of a digital content service before the 14-day cooling-off period has expired and acknowledges the right to cancel will be lost, the right to withdraw does not apply.
Cancellation
You may cancel your subscription at any time via the Stripe Billing Portal link provided in your welcome email. Cancellation takes effect at the end of the current billing period. No further charges will be made after cancellation. Cancellation does not entitle you to a refund for any already-paid billing period.
Service Description & Limitations
DailyNod delivers automated SMS check-in messages to a designated senior participant and sends alert notifications to a designated family contact if no response is received within the defined window. The Service is delivered on a best-effort basis via Twilio's SMS infrastructure.
Samo does not guarantee 100% SMS delivery rates, uptime, or alert latency. Network conditions, carrier restrictions, and third-party infrastructure may affect delivery. Samo accepts no liability for failed or delayed deliveries.
Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
